Distinction between delegated legislation and administrative directions

🔹 1. Meaning

Delegated Legislation

  • Refers to rules, regulations, by-laws, or orders made by an authority under powers delegated by the legislature (e.g., Parliament or State Legislature).
  • It has the force of law.

Administrative Directions

  • These are instructions, guidelines, or circulars issued by administrative authorities for internal governance.
  • They do not have the force of law.

🔹 2. Source of Power

  • Delegated Legislation: Derived from a statute (parent/ enabling Act).
  • Administrative Directions: Derived from executive powers, often under Article 73 of the Constitution of India and Article 162 of the Constitution of India.

🔹 3. Legal Status

  • Delegated Legislation: Legally binding; enforceable in courts.
  • Administrative Directions: Not legally binding on citizens; mainly binding internally on departments.

🔹 4. Enforceability

  • Delegated Legislation: Violation leads to legal consequences; can be challenged in court.
  • Administrative Directions: Generally not enforceable in courts unless they affect rights or are arbitrary.

🔹 5. Procedure

  • Delegated Legislation: Must follow prescribed procedure (publication, laying before legislature, etc.).
  • Administrative Directions: No strict procedural requirements.

🔹 6. Scope

  • Delegated Legislation: Deals with matters affecting public rights and obligations.
  • Administrative Directions: Mostly for internal administration and policy guidance.

🔹 7. Judicial Control

  • Delegated Legislation: Subject to judicial review on grounds like ultra vires, arbitrariness, etc.
  • Administrative Directions: Courts interfere only if directions are arbitrary, discriminatory, or violate fundamental rights.

🔹 8. Examples

  • Delegated Legislation: Rules under an Act, municipal by-laws, government regulations.
  • Administrative Directions: Government circulars, office memoranda, policy guidelines.

🔹 Key Case Law

  • In State of Uttar Pradesh v. Babu Ram Upadhya, the Supreme Court distinguished between statutory rules and administrative instructions.
  • In Sant Ram Sharma v. State of Rajasthan, it was held that administrative instructions can supplement rules but cannot override them.

🔹 Conclusion

  • Delegated legislation = law (binding, enforceable)
  • Administrative directions = guidance (non-binding, internal)
